Terms of Use

WHO WE ARE

We are FORYU BY ONI ONI ENTERPRISE, (Company Registration No. 202403211411 (TR0307087-D)), having our business address at 2-15-19 SOLARIA RESIDENCES JALAN MEDAN RAJAWALI, 11900 BAYAN LEPAS, PULAU PINANG ("For Yü"). These Terms and Conditions are our copyrighted intellectual property. Any unauthorized use or reproduction of these Terms and Conditions, in whole or in part, for commercial purposes is strictly prohibited. We reserve all rights to take legal action against any such infringement.

DEFINITIONS

  1. Account: Your user account on the "For Yü" app, which allows you to place orders.
  2. App: The "For Yü" mobile application available on iOS and Android.
  3. Business Day: Any weekday (Monday to Friday) from 9:00 AM to 6:00 PM Malaysian time, excluding Saturdays, Sundays, and public holidays.
  4. Contract: Your confirmed order for one or more products purchased through the app in accordance with these Terms and Use. Confirmation happens when we accept your order (see clause 6.3 below).
  5. Customer: Anyone who places an order through the "For Yü" app or website or any other channel.
  6. Gift Card: A physical or electronic gift card you purchased or received for use on the app.
  7. Order: Your request to purchase one or more products from us through the "For Yü" app or website or any other channel.
  8. Order Confirmation: Our email acknowledging your order
  9. Platform: Refers to the "For Yü" app and any future websites or applications we might own or operate.
  10. Product: Any item available for purchase on any "For Yü" channel.
  11. Website: means the "For Yü" website accessed at the following address at foryu.my;.
  12. You: means the Customer or a guest
  13. Clause: Refers to specific sections within these Terms of Use.
  14. Headings: Titles used for organization and do not affect the interpretation of these Terms and Use.
  15. Singular/Plural: Words used in singular form also apply to plural and vice versa.
  16. Gender: The terms used are gender-neutral. "Person" applies to individuals, companies, corporations, firms, or partnerships.
  17. Includes: When used in a definition, it means "without limitation."

ELIGIBILITY

To place an Order with "For Yü", you must be over eighteen (18) years of age. If you are under eighteen (18), you may place an Order with "For Yü" only with the involvement of a parent or guardian.

PROHIBITIONS

  1. You must not misuse our "For Yü" Platform.
  2. You shall not use any automated systems or software to extract data from this Platform for any purpose.
  3. You shall not commit or encourage a criminal offense, transmit or distribute a virus including but not limited to Trojan horse, worm, logic bomb or post any other material on the Platform which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene.
  4. You shall not hack into, corrupt data, cause annoyance to other users, infringe upon the rights of any other person's proprietary rights, send any unsolicited advertising or promotional material, or attempt to affect the performance or functionality of any computer facilities of or accessed throughout the Platform.
  5. Any breach of this provision would constitute an offence under Section 233 of the Communications and Multimedia Act 1998.
  6. In the event such breach occurs, "For Yü" will report the breach to the relevant law enforcement authorities and appropriate legal action will be taken.

ENTIRE AGREEMENT

  1. These Terms and Conditions shall apply to your use of the "For Yü" Platform and all Orders and Contracts made or to be made by us for the sale and supply of Products.
  2. These Terms and Conditions constitute the entire agreement between you and "For Yü" and supersede any and all preceding and contemporaneous agreements between us.
  3. You acknowledge that by entering into this Contract, neither you nor we have relied on any representation, undertaking or promise given by the other or implied from anything said or written between you and us prior to such Terms and Conditions, except as expressly stated in the Terms and Conditions.

TERMS OF SALE

  1. 6.1 Guest Checkout

    You may place an Order without creating an account. We will collect the necessary information from you during the checkout process.

  2. 6.2 Registration

    • (a) You must only submit to us information which is accurate and true. You must also keep your information up to date by informing us of any changes, by using relevant sections of the Platform.
    • (b) You shall not misuse the Platform by creating multiple user accounts.

  3. 6.3 Formation of a Contract

    • (a) The information set out in the Terms and Conditions and the details contained on this Platform do not constitute an offer for sale but rather an invitation to treat. No Contract in respect of any Products shall exist between you and us until we have shipped the Products to your address.
    • (b) To submit an Order, you will be required to follow the online shopping process on the Platform. After this you will receive an Order Acknowledgment which will act as an acknowledgement of our receipt of your Order. You acknowledge that the receipt of an Order Acknowledgment is not considered an acceptance of your Order by us.
    • (c) An Order is only considered accepted by us upon your Order being shipped to the delivery address provided by you, at which time you will receive an email notifying you that the Order has been shipped. Please check on the order status via the Platform.
    • (d) A Contract will relate only to those Products which we deliver to you. If your Order consists of more than one Product, the Products may be delivered to you in separate packages at separate times.

  4. 6.4 Price and Payment

    • We strive to ensure all prices and descriptions are accurate. However, errors may occur. If we find a pricing error in your Order, we may, at our discretion, cancel the Order and notify you. If you've already paid, you'll receive a full refund as per our Returns and Refunds Policy.
    • Prices include GST (where applicable) and are in Malaysian Ringgit.
    • Delivery fees are additional and clearly displayed.
    • We're not obligated to fulfill an Order if the listed price is incorrect, even after confirming your Order.
    • You can pay using our listed payment partners or cash on delivery.
    • You may also use e-gift cards, store credit, or promotional vouchers.
    • If you are using credit card as your payment method, we will use encryption to protect your card data and we pre-authorize your card to ensure sufficient funds.
    • Your card will be charged after we send you the Order Confirmation.
    • Card issuers may validate and authorize transactions.
    • We're not liable for delays or non-delivery if we don't receive authorization.
    • By clicking "Order now", you confirm the card is yours or you legitimately hold the e-gift card/voucher and have enough funds to cover the cost.

  5. 6.5 Mistaken Orders

      If you discover that you have made a mistake with your Order after you have submitted it to the Platform, please contact hello@foryu.my immediately. We will try our best to process your request.

  6. 6.6 Refusal of Order

    • We reserve the right to remove or edit Products or content on our platform at any time.
    • While we strive to process all Orders, there may be exceptional cases where we need to cancel an Order after sending you an Order Confirmation.
    • If we cancel your Order and you've already paid, we'll provide a full refund.
    • We're not responsible for any losses or damages caused by removing Products, editing content, or refusing an Order.

DELIVERY

  1. We aim to deliver the Product to you at the place of delivery requested by you in your Order and the delivery date and time indicated by us at the time of your order checkout (as updated in the Order Acknowledgement).
  2. We will attempt to notify you if we expect to be unable to meet our estimated delivery date, but, to the extent permitted by law, we shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery.
  3. Upon delivery of the Product, you may be required to sign for delivery. You may contact For Yü Customer Service via hello@foryu.my. You shall be able to provide the documents delivered with the Product, upon request. If you have not received your Order but the order status is showing as 'delivered', please contact For Yü Customer Service at hello@foryu.my. Our Customer Service Team will advise you accordingly.
  4. Please note that it might not be possible for us to deliver to some locations, in which event we will inform you using the contact details that you provided to us when you made your Order and arrange for cancellation of the Order or delivery to an alternative delivery address.
  5. We deliver in our standard packaging unless extra giftbox purchased together with the order.
  6. All risk in the Product shall pass to you upon delivery, except that, where delivery is delayed due to a breach of your obligations under a Contract (for e.g. see 7.8 below), risk shall pass at the date when delivery would have occurred but for your breach. From the time when risk passes to you, we will not be liable for loss or destruction of the Product.
  7. If you are not available to take delivery or collection, we will attempt to contact you. A re-delivery will be attempted the next working day. You may also contact our Customer Service Team or the courier.
  8. For Yü provides free or discounted shipping on all orders above the threshold set out in the Shipping Fees Policy.

CANCELLATION BY CUSTOMER (NON-FAULTY PRODUCT)

If you wish to cancel your Order, you may cancel via the Platform. Cancellation is only available for Orders that are not packed. You may reach out to our Customer Service Team by dropping us an email at hello@foryu.my. No cancellation fees shall be applicable. Once an Order has been packed it may not be cancelled and the item must instead be returned to the company according to our Return Policy in clause 9. Any payment made will be refunded.

RETURNS AND REFUNDS POLICY

  1. Returns: We accept returns following our Return Policy. If unsatisfied with your purchase, you can return the Product within 30 days of receipt, following our Exchange or Refund/Return Policy. The Product must be unused, with original packaging and tags intact (if applicable). This excludes non-refundable brands/items listed on our platform.
  2. Return Conditions: To qualify for a refund or replacement, For Yü must receive all items. Ensure the Product is returned in the original received condition and properly packaged. We reserve the right to refuse returns and return them if unsuitable. Misusing our policy may lead to legal action.
  3. No Walk-in Returns: We don't accept walk-in returns.
  4. Return Processing: Your return, along with the slip, is usually received and accepted within 5 business days after drop-off. Processing time depends on your chosen return method. Quality Check takes up to 2 business days for processing.
  5. Refunds and Exchanges: Refunds are issued after receiving and checking your return, using your preferred method on the slip. Exchanges will be refunded as store credit for future purchases. If you prefer a different refund method, contact our Customer Service team via chat or email at [email address removed]. See our Exchange or Refund/Return Time Frame Policy for more details.

FAULTY PRODUCTS

  1. All Product descriptions, information, and materials posted on the For Yü Platform are provided 'as is' and without warranties expressed, implied, or otherwise, and however arising.
  2. Product images seen on the For Yü Platform may slightly differ from the actual Product you receive.
  3. If the item you receive is faulty, contact our Customer Service Team with your Order number, name, address, Product details, reason for return, and whether you need a refund or replacement. See [link] for more details.
  4. Upon receiving the Products, we'll examine them and advise you on the replacement or refund status via email as soon as possible.
  5. For Yü may, at its discretion, refuse a replacement/exchange order and offer a refund instead, subject to clause 9.
  6. If the returned Product is not faulty or the process in clause 10.3 wasn't followed, we may decide not to replace or refund the Product and return it to you. In such cases, you may be responsible for carriage and servicing costs, which we'll charge to your card. We're not liable for any losses, liabilities, costs, damages, charges, or expenses arising from this.

VOUCHERS AND GIFT CARDS

  1. You may use promotional voucher codes and Gift Cards while making payment for Products on the For Yü Platform. Specific details for promotional voucher codes and Gift Cards are listed below.
  2. For Yü may, at its sole discretion, exercise its right to cancel or modify orders, require different means of payment, revoke or limit the use of any promotional voucher code or Gift Card, revoke or limit the use of store credits in your Wallet and/or close your Account at any time without any compensation or refunds in the following circumstances:
    1. if we reasonably believe that the promotional voucher code or Gift Card was obtained, used, or applied fraudulently, unlawfully, illegally or otherwise in breach of these Terms and Conditions or any other terms and conditions that may apply to the promotional voucher code or Gift Card;
    2. if we reasonably believe that the promotional vouchers or Gift Cards were used to facilitate any business or commercial purposes, including the resale or export of Products purchased from For Yü; or
    3. if we reasonably believe that the use of the promotional voucher code or Gift Card is detrimental to For Yü's customers, reputation, goodwill, business or operations.
  3. We assume no liability for the loss, theft or ineligibility of promotional voucher codes or Gift Cards.
  4. Conditions for the use and redemption of promotional vouchers:
    1. Promotional voucher codes are valid for the specified period stated on the voucher, can only be redeemed once and, unless otherwise stated, may not be used in conjunction with other promotional vouchers and discounted items. We may exclude individual brands from voucher promotions in accordance with our sales strategies. The current list of exclusions can be found here.
    2. You may redeem only ONE promotional voucher code per promotional campaign (unless otherwise stated). For Yü reserves the right to cancel any subsequent orders made by you using a promotional voucher code of the same promotional campaign.
    3. If you place an Order for a Product less than the value of the promotional voucher code, no refund or residual credit will be returned to you.
    4. The credit of a promotional voucher code does not accrue interest, nor does it have a cash value.
    5. Promotional voucher codes must be entered at the check-out page online only.
    6. If the credit of a promotional voucher code is insufficient for the Order you wish to place, you may make up the difference using one of our accepted payment methods.
    7. For promotional voucher codes/discount codes stipulated for a specified sum, if you choose to return the product, you will not be refunded the value of the promotional voucher/discount. However, if you paid partly with your own funds, this portion will be refunded.
    8. For Yü may specify additional terms and conditions in relation to specific promotional voucher codes. In such cases, the additional terms and conditions will govern the use and redemption of such promotional voucher codes, together with these terms.
    9. In rare cases, For Yü may at its sole discretion discontinue or cancel any promotional voucher codes previously issued and will not be responsible for any losses arising therefrom.

DISCLAIMER OF LIABILITY

  1. The content displayed on the For Yü Platform is provided 'as is' and without warranties expressed, implied, or otherwise, and however arising.
  2. For Yü and its suppliers, content providers, and advertisers exclude all conditions, warranties, and other terms that might otherwise be implied by statute, common law, or the law of equity.
  3. For Yü is not liable for any damages whatsoever, including direct, indirect, special, consequential, punitive, or incidental damages, or damages for loss of use, profits, data, or other intangibles.
  4. For Yü is not liable for damage to goodwill or reputation, or the cost of procurement of substitute goods and services arising out of or related to the use, inability to use, performance, or failures of the For Yü Platform and any materials posted thereon.
  5. These exclusions apply regardless of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law, or otherwise.
  6. Nothing in these Terms and Conditions shall exclude or limit For Yü's liability for death or personal injury arising from its negligence, fraudulent misrepresentation, and misrepresentation as to a fundamental matter or any other liability which cannot be excluded or limited under applicable law.

INDEMNITY

You agree to indemnify, defend, and hold harmless For Yü, its directors, officers, employees, consultants, agents, and affiliates, from any and all third-party claims, liability, damages, and/or costs (including but not limited to, legal fees) arising from your use of the For Yü Platform or your breach of these Terms and Conditions.

GUARANTEE AND COMPLAINTS MANAGEMENT

  1. For Yü shall perform its obligations under these Terms and Conditions with reasonable skills and care.
  2. We value our Customer satisfaction. You may contact us at any time using the contact details here. We will attempt to address your concerns as soon as possible and will contact you on receipt of any relevant enquiry or complaint. In guarantee cases, the manufacturer or supplier must generally be involved, and as such it may take longer to resolve such an enquiry or complaint.
  3. In the event of a complaint, it will help us if you can describe the object of your complaint as accurately as possible and, where applicable, send us copies of the Order or at least the Order number that was assigned to you in the Order Acknowledgment.
  4. In rare cases, your emails may be caught up in our spam filters or not reach us, or correspondence that we send to you may otherwise not have reached you. If you did not receive any response from us within five (5) Business Days, please make further enquiries.

PERSONAL DATA PROTECTION

Please see our Privacy Policy, which forms a part of these Terms and Conditions.

CIRCUMSTANCES BEYOND OUR CONTROL (FORCE MAJEURE)

  1. We shall not be liable to you for any breach, hindrance, or delay in the performance of a Contract attributable to any cause beyond our reasonable control, including but not limited to:
    1. Strikes, lock-outs, or other industrial action;
    2. Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
    3. Fire, explosion, storm, flood, earthquake, subsidence, pandemic, epidemic, or other natural disaster;
    4. Impossibility of the use of railways, shipping, aircraft, motor transport, or other means of public or private transport;
    5. Impossibility of the use of public or private telecommunications networks;
    6. The acts, decrees, legislation, regulations, or restrictions of any government, shipping, postal, or other relevant transport strike, failure, or accidents.
  2. In the circumstance that the Force Majeure event lasts for more than one week, either you or For Yü may terminate the Contract forthwith by written notice and without any liability other than a refund of a Product already paid for by you and not delivered.
  3. If we have contracted to provide identical or similar Products to more than one Customer and are prevented from fully meeting our obligations to you by reason of a Force Majeure event, we may decide at our absolute discretion which Contracts we will perform and to what extent.
  4. For Yü reserves absolute discretion on the solution we adopt in fully meeting our obligations under the Contract despite the Force Majeure Event.

WAIVER

No failure or delay by us or you in exercising any right under these Terms and Conditions or a Contract shall operate as a waiver of such right or extend to or affect any other or subsequent event or impair any rights or remedies in respect of it or in any way modify or diminish our or your rights under these Terms and Conditions or a Contract.

SEVERABILITY

If any part of these Terms and Conditions or a Contract is found invalid or unenforceable by a court, the rest of the agreement will still be valid and enforceable.

ASSIGNMENT

You shall not assign, transfer, novate, charge, sub-Contract, create any trust over or deal in any other manner with these Terms and Conditions or a Contract or all or any of your rights or obligations under these Terms and Conditions or a Contract.

RELATIONSHIP

Nothing in these Terms and Conditions or a Contract shall create or be deemed to create a partnership, an agency or a relationship of employer and employee between you and us.

THIRD PARTY RIGHTS

Only the parties to these Terms and Conditions or a Contract have rights under it. Third parties cannot benefit from these terms, even if they have relied on them or indicated their assent to them.

GOVERNING LAW

  1. These Terms and Conditions and any related non-contractual obligations are governed by Malaysian law.
  2. Both you and For Yü agree to submit to the non-exclusive jurisdiction of Malaysian courts.
  3. All dealings, correspondence, and contacts between us shall be conducted in English.

VARIATION

  1. We reserve the right to amend these Terms and Conditions and our policies at any time at our sole discretion without prior notice.
  2. All amendments will be posted on the For Yü Platform and be effective immediately.
  3. Your continued use of the For Yü Platform constitutes acceptance of the amended Terms and Conditions.

ACCOUNT TERMINATION

  1. We may, at our discretion, with or without notice, and without assuming any liability to you or third parties, terminate your Account, cancel any transactions associated with your Account, temporarily or permanently withhold any sale proceeds or refunds, and/or take any other actions that For Yü deems necessary.
  2. These measures may be implemented upon reasonable assessment that there has been:
    1. a violation of these Terms and Conditions or For Yü policies;
    2. illegal, fraudulent, harassing, defamatory, threatening, or abusive behavior;
    3. creating multiple user accounts;
    4. voucher/promotion abuse;
    5. high/excessive cancellation upon delivery;
    6. behavior that is harmful to other Users, third parties, or any reasons identified that have an impact on the company's overall business operations.
  3. This clause is not exclusive of other remedies that may be available to For Yü under existing Malaysia laws.
